Joint Press Release of the Electoral Commissions on Validating the Votes of People in the October 20, 2018 Elections

The electoral commissions, while acknowledging the extensive participation of people in elections, are committed to observance of law and protection of votes of the people as a trust. Given the status quo of the country and considering some of the irregularities during the E Day, a great deal of complaints have been received by the commissions in relation to negligence, violation and electoral crimes.

Recognizing the views of the political parties, the CSOs and people of Afghanistan, the electoral commissions are committed to discharging of their legal duties and obligations in an independent way to protect the votes of the people. Both the commissions, as part of their furthered coordination and while observing the Election Law and their regulations, procedures and decisions, agree on the following points for better management of the tallying of votes, adjudication of the received complaints and preventing any possible irregularities during the upcoming phases:

  • Those votes of ballot boxes of the PSs and PCs that are used based on the BVV and according to the Voter List of the relevant PS on the E Day, are valid unless proved otherwise according to the applicable legal instruments and other credible reasons and documents.
  • Those votes of ballot boxes of the PSs and PCs that are used based on the BVV in lack of the Voter List of the PS and based on the manually prepared list, if such votes reconcile with the original Voter List of the central database of the IEC, are considered valid unless proved otherwise according to the applicable legal instruments and other credible reasons and documents. 
  • Those votes of ballot boxes of the PSs and PCs that are used based on the Voter List are considered valid if their veracity has been confirmed according to the procedure by the PS Chairperson and the agents and observers present in the same PS, if there is no objection and complaint filed against the ballot box and the voting has taken place considering the law and the applicable regulations.
  • Those votes of ballot boxes of the PSs and PCs that are used in lack of official Voter List, without BVV and according to manually prepared list that does not match the original list and/or in absence of representatives of the electoral commissions, agents and observers, such votes lack validity.
  • The electoral commissions are committed to holding joint meetings for enacting those regulations and procedures that are relevant to the work of both the commissions and for taking necessary decisions.
  • The provincial offices of the electoral commissions, to improve the affairs according to the law and the applicable procedures and in presence of monitors and observers, extend mutual support to each other as necessary.
  • The electoral commissions establish a joint committee at their HQ level to accelerate the process.
  • When as a result of investigations that are based on credible documents and proofs it is proved that the staff and managers of the electoral commissions irrespective of their hierarchy and/or candidates and other stakeholders of the elections have committed negligence in discharge of their activities or perpetrated an electoral crime and have dealt a blow to the national process of the elections, such persons will be referred to judicial authorities for trial.
